By purchasing, installing, or using any product sold by CMPOWERS LLC, doing business as CMpowers ("CMpowers," "we," "us," or "our"), including but not limited to e-bike controller kits, motor conversion kits, powertrain components, and batteries (collectively, the "Products"), you ("User," "Buyer," or "you") agree to the following terms and conditions. If you do not agree with any part of this disclaimer, do not purchase, install, or use the Products.
1. Use At Your Own Risk
CMpowers Products, including controller kits, hub motor conversion kits, and high-power battery packs, are performance-modifying aftermarket components intended for use by knowledgeable riders and builders. Certain Products — including but not limited to motor kits rated above 750W — may not be street legal in all jurisdictions and may cause a bicycle to no longer qualify as a legally defined "e-bike" under applicable federal, state, or local law. It is the sole responsibility of the User to verify the legality of any Product for use in their specific location, on their specific vehicle, and for their intended riding environment (public road, bike path, off-road, or private property) before installation or use.
CMPOWERS LLC, its owners, employees, affiliates, manufacturers, and distributors are not responsible for any injury, accident, death, damage, citation, impoundment, or loss resulting from the purchase, installation, or use of any Product.
2. No Liability for Misuse or Modification
CMpowers Products are intended for use by competent individuals with a working knowledge of e-bike systems, electrical components, and mechanical safety. Improper installation, use, or post-purchase modification of a Product voids all warranties and releases CMPOWERS LLC from any liability.
We shall not be held responsible for:
- Improper installation, assembly, or wiring;
- Installation by unauthorized, unqualified, or inexperienced personnel;
- Use of a Product on a bicycle or frame not rated or intended for its power output;
- Any modification made to a Product after purchase;
- Use in racing, high-risk, or unsupervised off-road environments;
- Failure to perform regular safety checks, torque checks, or maintenance;
- Voltage, connector, or dimensional mismatches between a Product and the User's specific bike, motor, or battery system.
3. Safety Warning
Aftermarket e-bike components — including controller kits, hub motor conversion kits, and high-capacity batteries — alter the speed, torque, acceleration, braking behavior, weight distribution, and electrical characteristics of a bicycle. These changes may affect a bike's stability, control, and braking ability, particularly on bikes not originally engineered for the increased power output. Use extreme caution, and always perform a thorough post-installation inspection — including brake function, wiring security, and battery mounting — before operating a modified bike.
We strongly recommend installation by a certified bicycle mechanic or qualified technician, particularly for motor conversion kits and battery systems.
4. High-Power Products (1500W+) — Additional Notice
Certain CMpowers Products, including high-torque hub motor conversion kits rated at 1500W–2000W and above, significantly exceed the U.S. federal e-bike motor limit of 750W (per the Consumer Product Safety Commission's e-bike definition) and the speed thresholds that define a legal Class 1–3 e-bike (20 mph throttle-assisted / 28 mph pedal-assisted). Operating a bicycle equipped with such a Product on public roads, bike lanes, or bike paths may be illegal without proper registration, insurance, and/or licensing, depending on your state and local ordinances. These Products are intended for off-road, private property, and closed-course use only. It is the User's sole responsibility to determine and comply with all applicable laws before use.
5. Limitation of Liability
To the fullest extent permitted by applicable law, CMPOWERS LLC:
- Disclaims all implied warranties, including but not limited to merchantability and fitness for a particular purpose;
- Shall not be liable for any direct, indirect, incidental, special, or consequential damages, including but not limited to injury, death, or property damage, arising from the purchase, installation, or use of any Product;
- Limits its total liability, in any case and to the maximum extent permitted by law, to the purchase price paid for the Product giving rise to the claim.
6. User Responsibility
By purchasing and using CMpowers Products, you acknowledge and agree that:
- You assume all risks related to the installation and operation of the Product;
- You are solely responsible for ensuring the Product is installed properly and used safely;
- You are solely responsible for confirming compliance with all local, state, and federal laws and regulations regarding aftermarket e-bike components, including e-bike classification, motor wattage limits, and speed limits;
- You release and hold harmless CMPOWERS LLC from any and all claims, damages, or liabilities arising from the use or misuse of any Product.
7. Brand Compatibility Disclaimer
CMpowers Products are frequently described as "compatible with" or usable on popular e-bike platforms such as Macfox, Super73, Zooz, and other brands. These references describe compatibility only. CMpowers Products are aftermarket parts and are not manufactured by, affiliated with, sponsored by, or endorsed by Macfox, Super73, Zooz, or any other bicycle manufacturer referenced in our product listings. All third-party brand names and trademarks are the property of their respective owners and are used solely for the purpose of describing compatibility. Installing a CMpowers Product on a bike from any of these manufacturers may void that manufacturer's original warranty.
8. Intellectual Property
All CMpowers branding, logos, design elements, product descriptions, and other intellectual property associated with CMpowers Products are owned by CMPOWERS LLC. Unauthorized reproduction, resale, or misrepresentation of CMpowers Products is strictly prohibited and may result in legal action.
9. Warranty Disclaimer
Unless expressly stated otherwise in writing at the time of sale, CMpowers Products are sold "AS IS" with no warranty, express or implied. Any performance, fitment, torque, top-speed, or range claims are based on general compatibility and typical use, and actual results may vary by bike make, model, rider weight, terrain, and battery condition.
10. Jurisdiction and Governing Law
This disclaimer, and any dispute related to any CMpowers Product, shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. You agree to submit to the personal jurisdiction and venue of the courts located in Broward County, Florida.
11. Amendments
CMPOWERS LLC reserves the right to update, change, or modify this disclaimer at any time without prior notice. The current version will always be available on this page.
